Sometimes a debtor calls an attorney days, or hours, before a foreclosure sale, a car repossession, or a wage garnishment. The automatic stay that starts when a bankruptcy case is filed can pause those actions, so attorneys sometimes make an emergency bankruptcy filing with only the minimum papers and complete the rest afterward. This is often called a skeleton filing. For a virtual bankruptcy assistant (VBA) or bankruptcy petition preparer, being able to prepare the essentials quickly and accurately makes you extremely valuable to an attorney.
This guide explains what an emergency filing involves, what must be ready on day one, what can wait, and the risks everyone needs to understand. The decision to file, and when, is always the attorney's.
What is a skeleton (emergency) filing?
A skeleton filing is a bankruptcy case opened with the minimum required documents. It exists because the law gives the debtor a short period after filing to submit the full schedules and statements. Used appropriately, it can stop a sale or other collection action while the complete petition is finished. Used carelessly, it can backfire: a case missing required papers can be dismissed.
What the debtor can accomplish, and what the stay does not do
Filing triggers the automatic stay, which generally stops most creditors from continuing collection activity, including a scheduled foreclosure sale. But don't promise the debtor anything. The stay has limits, and in some situations, especially when the debtor has filed before and the earlier case was dismissed, it can be limited or may not apply unless the court extends it. Those questions are for the attorney. For more on how foreclosure and bankruptcy interact, see Foreclosure and Bankruptcy.
What must be ready on day one
The exact requirements depend on the court, so confirm them with the attorney and the court's local rules. In general, an emergency filing includes:
- The voluntary petition (Official Form 101), with accurate names, addresses, and the correct Social Security or tax ID number
- The list of creditors (creditor matrix), complete and with correct addresses. A creditor left off the matrix may not be notified. Include the mortgage servicer, the foreclosure attorney, and any collection agency you know of.
- The Statement About Your Social Security Numbers (Official Form 121)
- Proof of credit counseling from an approved provider, or a request for an exception based on exigent circumstances. Debtors normally must complete counseling before filing, and the exception is narrow and requires the attorney's certification. Don't treat it as a routine shortcut.
- The filing fee, or an application to pay in installments or to have the fee waived, depending on the case. Fees change, so check the court's current fee schedule.
- The attorney's engagement and disclosure paperwork, per the firm's process
In Chapter 13, the court may also require certain additional papers at the start, and the plan is due soon after filing. Ask the attorney which apply.
What is due shortly after
After a skeleton filing, the debtor has a limited window, generally about 14 days under the federal rules, to file the remaining schedules, statements, and (in Chapter 13) the plan. Some items, like pay stubs and the means-test forms, must be filed within that time or shortly after. If you need more time, the attorney has to ask the court for an extension, and a court is not required to grant it.
The risk is real. If required information is not filed on time, the case can be dismissed, and the bankruptcy code includes an automatic dismissal provision for missing documents. A dismissed case can leave the debtor worse off: the protection ends, and refiling can come with restrictions. That is why a skeleton filing is only as good as the work done afterward.
What a prepared assistant does
When an attorney says “I need to file by Thursday”, the VBA's job is to make the emergency manageable:
- Collect the sale information immediately: property address, the date and time of the sale, the lender and servicer, and the foreclosure attorney's contact information. Give it to the attorney first.
- Build the creditor matrix from the credit report and every bill, letter, and notice the debtor can find. Accuracy matters more than speed here.
- Confirm the credit counseling certificate is complete, or tell the attorney it is missing.
- Prepare the petition and statement forms from what is known, and mark what is still unknown.
- Start the full petition immediately. The 14-day clock begins when the case is filed. Begin the intake follow-up that day. See How to Ask Debtors for Missing Documents.
- Flag the risks: a prior filing in the last several years, recent transfers, missing income documents, and any other issue the attorney must see. Use PACER to check for prior cases. See How to Value Property on a Bankruptcy Petition for public-records research.
An emergency checklist you can copy

| Creditor matrix complete, including servicer and foreclosure counsel | |
| Credit counseling certificate in hand, or the attorney's decision on the exception | |
| Fee, installment application, or waiver arranged | |
| Attorney has reviewed the petition and the debtor has signed | |
| Deadline for remaining documents calendared, with a reminder two days before | |
| Intake follow-up sent to the debtor the day of filing |
Staying on the right side of the line
Emergency situations are when debtors beg for guarantees and preparers are most tempted to reassure them. Don't. You can say “Your attorney is working on this today and I am preparing everything they need.” You cannot say “This will stop the sale.” See Unauthorized Practice of Law for scripts.
Also remember that preparing an emergency filing for an attorney means you are not the one who files or signs. The attorney reviews and is responsible. For more on supporting attorneys safely, see How VBAs Can Help Protect Their Attorneys.

Frequently asked questions
Does an emergency filing always stop a foreclosure sale?
Generally the automatic stay pauses a sale once a case is filed, but there are exceptions, especially for repeat filers. Only the attorney can advise on a particular case.
Can the petition be filed without all the schedules?
Often yes, with the remaining documents due shortly after, but requirements vary by court. Confirm with the attorney and local rules.
What happens if the documents aren't filed in time?
The case can be dismissed. The attorney can ask the court for an extension, but it is not guaranteed.
Is a skeleton filing a good idea?
That is a legal strategy decision for the attorney and the debtor.
